These Terms & Conditions (“Terms”) govern the use of https://charterculebra.com (the “Website”) and the booking of boat charter tours to Culebra Island operated by Charter Culebra (“we,” “us,” or “our”).

By accessing this Website or booking a charter, you agree to be bound by these Terms.

1. Services

Charter Culebra provides private boat charter tours to Culebra Island. All tours are subject to availability, weather conditions, and operational considerations.

We reserve the right to refuse service to anyone for safety, legal, or operational reasons.

2. Booking & Payment

  • All bookings must be made through the Website or approved communication channels.

  • Payments are processed securely through third-party payment providers, including Stripe and PayPal.

  • We do not store credit card or banking information.

  • A booking is not confirmed until payment is successfully completed and a confirmation is issued.

3. Pricing

All prices are listed in U.S. dollars unless otherwise stated. Prices may change at any time but will not affect confirmed bookings.

Taxes, fees, or additional charges may apply and will be disclosed prior to payment.

4. Guest Responsibilities

Guests agree to:

  • Follow all safety instructions provided by the captain and crew

  • Arrive on time at the designated departure location

  • Accurately disclose the number of passengers

  • Ensure all passengers are physically able to participate in the charter

Failure to comply may result in termination of the charter without refund.

5. Weather & Safety Cancellations

For the safety of our guests and crew, all charter tours are subject to weather and sea conditions.

Captain’s Authority

All decisions regarding departures, cancellations, delays, route changes, or early returns due to weather, sea state, mechanical issues, or safety concerns are made solely at the discretion of the captain/operator. These decisions are final.

Weather-Related Cancellations

If a charter is canceled by us due to unsafe weather or sea conditions:

  • Guests may choose to reschedule the charter at no additional cost, subject to availability, or

  • Receive a full refund of the amount paid.

Weather conditions are evaluated close to the scheduled departure time, as marine conditions can change rapidly.

Partial Trips & Modifications

If a charter departs but is shortened, delayed, or modified due to changing weather or safety conditions, no refunds will be issued, as the service has commenced and safety decisions must be made in real time.

Limitation of Responsibility

We are not responsible for additional expenses incurred by guests due to weather-related cancellations or changes, including accommodations, transportation, meals, or missed connections.

6. Guest Cancellations & No-Shows

Guest-initiated cancellations and no-shows that are not weather-related are subject to the cancellation policy displayed at the time of booking.

Failure to arrive on time may be considered a no-show and may result in forfeiture of the booking without refund.

7. Assumption of Risk

Boat charters involve inherent risks, including but not limited to weather conditions, sea movement, and water activities.

By booking a charter, guests voluntarily assume all risks associated with maritime travel and activities and agree to release Charter Culebra from liability to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Charter Culebra shall not be liable for:

  • Personal injury, illness, or property damage

  • Delays, cancellations, or route changes due to weather or safety

  • Indirect, incidental, or consequential damages

9. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, mechanical failures, or emergencies.

10. Intellectual Property

All content on the Website, including text, images, logos, and branding, is the property of Charter Culebra and may not be used without prior written consent.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Charter Culebra operates, without regard to conflict of law principles.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Website.
